Welcome to Shop the Borders e-commerce site. By using our website and purchasing art from this site, you agree to the following terms and conditions. Please read them carefully.
1. Definitions
- "Gallery" refers Shop the Borders, the eCommerce platform for buying and selling art.
- "Artist" refers to any individual, or entity, who displays their art for sale on the Gallery.
- "Customer" refers to any individual, or entity, who purchases art from the Gallery.
2. Acceptance of Terms
By accessing and using the Gallery's website, you agree to comply with these terms and conditions. If you do not agree, please do not use the site.
3. Account Registration
- To purchase art, customers may be required to create an account. You must provide accurate and complete information during registration.
- Customers are responsible for maintaining the confidentiality of their account information and for all activities that occur under their account.
4. Artist Responsibilities
- Artists are responsible for the authenticity and quality of their artwork. By displaying their art on the Gallery, artists confirm that they hold the necessary rights to sell their work.
- Artists agree to provide accurate descriptions and images of their art. The Gallery is not liable for any discrepancies between the artwork and its depiction online.
5. Sales and Transactions
- All prices are listed in GBP and include VAT where applicable.
- Payment for purchases must be made at the time of order. The Gallery accepts various payment methods as specified on the site.
- The Gallery will remit agreed-upon commissions to the Artists for each sale made through the platform.
6. Shipping and Delivery
- The Gallery will handle the shipping of sold artworks unless otherwise agreed upon with the Artist.
- Delivery times may vary, and the Gallery will provide estimated shipping dates at the time of purchase.
- Risk of loss or damage to the artwork passes to the Customer upon delivery.
7. Returns and Refunds
- Customers have the right to cancel their order within [14 days] of receipt. To initiate a return, customers must contact the Gallery within this period.
- Customers will pay for the return of the artwork and any required insurance.
- The artwork must be returned in its original condition. Refunds will be processed within [14 days] of receiving the returned item.
8. Intellectual Property
- All content on the Gallery’s website, including text, images, and designs, is protected by copyright and intellectual property laws. Unauthorised use of any content is prohibited.
- Artists retain ownership of their artwork and grant the Gallery a non-exclusive license to display their work on the site.
9. Limitation of Liability
- The Gallery is not liable for any indirect, incidental, or consequential damages arising from the use of the website or the purchase of art.
- The Gallery’s liability is limited to the maximum extent permitted by law.
10. Governing Law
These terms and conditions are governed by the laws of Scotland. Any disputes arising from these terms will be subject to the exclusive jurisdiction of the courts of Scotland.
11. Amendments
The Gallery reserves the right to modify these terms and conditions at any time. Customers and Artists will be notified of any changes via email or through a notice on the website.
